Workplace Harassment

There is a fascinating case before the California Supreme Court that was written up on Page One of today's LA Times. Amani Lyle is a young woman who got a job as an assistant to the writers on Friends. Her job was to transcribe the brainstorming sessions. The nature of the writing for this show, with it's plentiful sexual overtones, was, of necessity, overtly sexual. She argues that she was subjected to a sewer full of vulgarity. The writers defend it as part and parcel of the job.
She is black, but the racial discrimination claim got booted out. What is left is whether this 'hostile work environment' is actionable.
The whole area of law of workplace harrassment took a left turn and ran off the road a long time ago. I have no problem with taking bosses who demand sex for promotions (quid quo pro) to the fire and roasting them on a spit, but the 'hostile workplace' aspect of this cause of action is too subjective in many cases and has a chilling effect on behavior in the work place.
I hope they throw her out on her butt in this case. They say that certain things should not be seen in their creation. I guess you can add raunchy tv shows to sausage making. If you work with sitcom writers in Hollywood, you shoud expect an environment akin to a guy's locker room. If you were a Jewish receptionist in a Christian Church, would you go to court to get an injuction preventing the mention of Jesus while you were at work? What's next, a cameraman at a porn shoot complaining that he had to watch sex on the job?

Nice blog post. Among all the workplace harassment, unwelcoming comments on castes, race, color, national region has been found to occur at par. One shouldn't keep quite on this. Raise your voice who are being harassment in any way.
